Terms & Conditions – Atal Skill Development Training Centers (ASDTC)

Welcome to the official website of Atal Skill Development Training Centers (ASDTC), a unit of Atal Foundation (ISO 9001:2015 Certified). By accessing or using our website, services, training programs, employment opportunities, or franchise offerings, you agree to abide by the following Terms and Conditions. Please read them thoroughly before engaging with ASDTC in any capacity.

1. General Terms

  • The terms “ASDTC”, “we”, “our”, or “us” refer to Atal Skill Development Training Centers.
  • The terms “you”, “your”, or “user” refer to any individual or entity accessing our website or availing our services.
  • These Terms apply to all visitors, users, clients, franchisees, students, employees, and partners.

2. Eligibility

  • You must be at least 18 years old or have parental/legal guardian consent to use our services.
  • Franchise partners, institutions, or organizations entering into business agreements must be duly registered and legally capable of signing binding contracts under Indian laws.

3. Intellectual Property Rights

  • All content on the ASDTC website including text, images, course materials, designs, logos, trademarks, and software is the exclusive property of ASDTC.
  • Unauthorized reproduction, distribution, modification, or commercial use of content is strictly prohibited.

4. Courses, Programs & Certifications

  • Enrollment in any ASDTC training program requires accurate documentation and full compliance with our academic and disciplinary guidelines.
  • Certification is subject to full course completion, minimum attendance, and performance-based evaluations.
  • Fees paid are non-refundable except in cases explicitly mentioned in our refund policy.

5. Government Projects & Affiliated Schemes

  • ASDTC is affiliated with national and state-level skill development schemes like PMKVY, DDU-GKY, UPSDM, UKSDM, and MOT Projects.
  • Government schemes are subject to eligibility norms, compliance checks, and government guidelines which may change without notice.
  • ASDTC holds no liability for delays or policy changes caused by government agencies.

6. Franchise & Partnership Agreements

  • Franchisees must sign a detailed Franchise Agreement outlining the scope, operational guidelines, branding rights, fee structure, training support, and performance expectations.
  • All franchisees must comply with ASDTC quality and operational standards.
  • ASDTC reserves the right to revoke or terminate franchise relationships for breach of agreement or non-performance.

7. Confidentiality & Non-Disclosure (NDA)

  • All parties (students, employees, franchisees, vendors) agree to maintain strict confidentiality regarding proprietary information, curriculum designs, business processes, data, client lists, and strategic plans.
  • A formal Non-Disclosure Agreement (NDA) may be signed with franchisees, employees, or consultants engaged in sensitive roles.
  • Any breach of confidentiality will invite legal action including compensation for damages and termination of services.

8. Data Privacy & Security

  • ASDTC collects limited personal data for registration, communication, and certification.
  • Data is protected under applicable Indian IT Act & GDPR-compliant security practices.
  • We do not sell, rent, or misuse user data.

9. Limitation of Liability

  • ASDTC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • We do not guarantee job placement but offer 100% assistance based on student eligibility and performance.

10. Code of Conduct

  • Any user or franchisee engaging in harassment, fraud, misrepresentation, or violation of our ethical code will face immediate action.
  • Students or franchisees engaging in plagiarism, false certification, or manipulation of training logs will face cancellation of certification and legal prosecution.

11. IT & Digital Training Compliance

  • All IT and digital training programs (e.g., AI, cybersecurity, digital marketing) are aligned with latest industry norms.
  • Students agree not to misuse any software, platforms, or tools provided by ASDTC for illegal, malicious, or unethical purposes.
  • Unauthorized software copying, code tampering, or digital theft is a punishable offense.

12. Payment Terms

  • All payments must be made in advance unless specifically agreed in writing.
  • GST and other taxes, if applicable, are additional.
  • Non-payment within stipulated time may lead to suspension or termination of services.

13. Job Applications, Interviews & Employment Policy

  • ASDTC follows a transparent, merit-based hiring process for all its job openings.
  • Job applicants must submit complete and truthful information in applications.
  • Shortlisted candidates will undergo assessments and interviews. Final selection will be based on merit, experience, qualifications, and organizational needs.
  • Employment is subject to signing of an Offer Letter, adherence to ASDTC’s HR policies, and submission of required documents.
  • Probation period, performance appraisal, and confirmation terms will be communicated in the offer.
  • Any falsification of documents or information during recruitment will lead to immediate disqualification or termination.
  • ASDTC is an equal opportunity employer and does not discriminate based on gender, caste, creed, religion, disability, or socioeconomic background.

14. Cancellation & Refund Policy

  • Training or franchise cancellation must be submitted in writing.
  • Refunds, if any, will be governed by ASDTC’s Refund Policy.
  • No refund will be entertained after course commencement or franchise agreement execution.

15. Dispute Resolution & Jurisdiction

  • All disputes arising out of or in connection with ASDTC shall be resolved through arbitration as per the Arbitration & Conciliation Act, 1996.
  • The jurisdiction for all legal disputes shall be Lucknow, Uttar Pradesh, unless otherwise specified.

16. Amendments to Terms

  • ASDTC reserves the right to update, modify, or replace these Terms and Conditions at any time without prior notice.
  • Continued use of the website and services after such changes constitutes acceptance of the updated terms.
